Iginiit ni National Prosecution Service (NPS) prosecutor general Atty. Richard Fadullon na walang karapatan ang mag-asawang Discaya para diktahan ang Department of Justice sa isinasagawa nitong ebalwasyon sa aplikasyon nila bilang testigo.
Binigyang diin ni Prosecutor General Fadullon na wala sa posisyon sina Pacifico ‘Curlee’ at Sarah Discaya o sinuman para magbigay ng anumang kondisyon sa hakbang ginagawa ng DOJ.
Sa kasalukuyan kasi ay nagpapatuloy ang ‘evaluation’ ng Department of Justice sa aplikasyon ng mga ito para mapasailalim sa naturang protection program.
”I don’t think they are in the position to demand anything at this time. They’re applying for supposedly witness protection coverage. And we have our procedures to determine weather or not they will be qualified or not,” ani Prosecutor General Richard Anthony Fadullon.
“It is not for anybody to dictate to us how we will go about doing the evaluation. It is not for anybody to impose any conditions,” dagdag pa ni P.G. Fadullon.
Habang kanyang sinabi na ang anumang aksyon gawin ng mag-asawa labas sa imbestigasyon ng kagawaran ay di’ gagamitin kontra o laban man sa kanila.
Titingnan pa aniya raw kung kaparehong hakbang ang ipapakita ng Discaya couple sa DOJ nang tuluyan nilang putulin ang kooperasyon sa Independent Commission for Infrastructure o I.C.I.
“Any action that they take outside of the department is not something that could be taken against them,” ani Prosecutor General Richard Anthony Fadullon.
“We will have to find out if they will also have the same kind of treatment pagdating sa pakikipag-usap samin sa Department of Justice,” dagdag pa ni P.G. Fadullon.
Maaalalang inihayag ng ICI na inihinto na ng mga Discaya ang kooperasyon sa imbestigasyong isinasagawa ng komisyon ukol sa flood control projects anomaly.
