Inabsuwelto ng Supreme Court (SC) ang kolumnistang si Raffy Tulfo laban sa kasong libelo na isinampa laban sa kanya dahil sa serye ng artikulong kanyang isinulat na “shoot to kill” sa pahayagang Abante Tonite.
Ito ay may kaugnayan pa rin sa umano’y iligal na aktibidad ng isang abogado ng Bureau of Customs (BoC).
Pero pinaalalahanan naman ng korte ang lahat ng media practitioners kaugnay ng standars na inaasahan sa kanila na nasa ilalim ng Philippine Press Institute’s Journalist Code of Ethics at Society of Professional Journalists Code of Ethics.
“We regard the vital role that the media plays in ensuring that the government and its officials remain true to their oath in carrying out their mandates in a manner prescribed by law…. Nevertheless, the constitutionally protected freedoms enjoyed by the press cannot be used as a shield to advance the malicious propagation of false information carried out by unscrupulous entities to injure another’s reputation,” ayon sa korte.
Taong 1999, isinulat ni Tulfo ang ilang artikulo kaugnay ng umano’y “shady dealings” sa BoC partikular sa napaulat na extortion activities laban sa brokers at shippers maging ang mga umano’y illicit affair na kinasasangkutan ni Atty. Carlos T. So ng BoC.
Base sa desisyon, ang isinulat ni Tulfo na umano’y iligal na aktibidad ni Atty. So ay bahagi lamang ng kanyang tungkulin bilang isang mamamahayag,
“Petitioner Tulfo reported the alleged illegal activities of Atty. So in the exercise of his public functions. Our libel laws must not be broadly construed as to deter comments on public affairs and the conduct of public officials. Such comments are made in the exercise of the fundamental right to freedom of expression and the press…Public officers are accountable to the people, and must serve them ‘with utmost responsibility, integrity, loyalty, and efficiency, act with patriotism and justice, and lead modest lives. Speech that guards against abuses of those in public office should be encouraged. Petitioner Tulfo should be acquitted,” ayon pa sa SC.
Sa desisyong isinulat ni Justice Marvic M.V.F. Leonen, ng SC Third Division, iginiit nitong bigo umano ang petitioner na patunayang mayroong malice ang mga isinulat ng correspondent.
Una rito, sinampahan ni So si Tulfo kasama sina Abante Tonite publisher Allen A. Macasaet at managing Nicolas V. Quijano ng 14 na kaso ng libelo sa Pasay City Regional Trial Court (RTC) para sila ay magmula at makulong.
Sa isang appeal, pinagtibay naman ng Court ang Appeals (CA) ang conviction ng tatlo noong Hulyo 31, 2006.
Pero dahil sa motion for reconsideration nag-isyu ang CA sa subject noong Marso 17, 2009 at nagkaroon ng pagbabago sa desisyon at inabswelto ang tatlo sa walong bilang ng libelo.
Pero pinanatili naman ang hatol sa nalalabi pang criminal cases at iniakyat ito sa Korte Suprema.
