Naglabas na ng cease and desist orders ang Securities and Exchange Commission (SEC) laban sa anim na online lending operators na nago-operate na walang karampatang permits.

Sa ilalim ng Commission en banc order na inilabas noong Oktubre 24, ipinag-utos ng SEC sa mga operators at may-ari ng Batis Loan, Happy Credit, Easy Cash, Wahana Credit & Loan Corp., PesoMaMa, at Light Kredit na kaagad na ihinto ang kanilang pautang.

“Certifications issued by the Commission’s Company Registration and Monitoring Department (CRMD) showed that Batis Loan, Happy Credit, Easy Cash, Wahana Credit & Loan Corp., PesoMaMa, and Light Kredit were not registered as corporations or partnerships,” sambit ng SEC.

“The CRMD further attested that the online lending operators were not issued the necessary certificates of authority to operate as lending companies nor had pending applications for such,” dagdag pa nito.

Sa ilalim ng Lending Company Regulation Act of 2007, lahat ng mga lending companies sa bansa ay dapat registered at pinapahintulutan ng SEC ang operasyon.

Ang sinumang lumabag sa batas na ito ay pagmumultahin ng mula P10,000 hanggang P50,000, o pagkakakulong ng anim na buwan hanggang 10 taon.

Samantala, ipinag-utos din ng SEC sa mga ipinapasarang lending operators na kaagad burahin o tanggalin ang kanilang promotional presentations at mga alok sa internet, kabilang na ang mga lending applications na kanilang ginagamit.

“Considering that these Online Lending Operators are not incorporated entities or have no Certificate of Authority to Operate as Lending Companies or Financing Companies, the lending activities and transaction are illegal and must be immediately stopped by this Commission,” dagdag pa nito.
