Nilabag ng National Telecommunications Commission (NTC) ang Saligang Batas nang maglabas ito ng cease and desist order para ipasara ang ABS-CBN, ayon sa isang kongresista.
Ayon kay Deputy Speaker Prospero Pichay Jr., partikular na nilabag ng NTC ang Article III, Section 1 ng Saligang Batas na nagsasabing hindi dapat ipinagkakait ang due proces sa kahit sinuman.
Gayundin aniya ang Article III, Section 4 ng Konstitusyon na nagbibigay proteksyon sa freedom of speech, expression at press.
“There is no higher law than the Constitution, and the Bill of Rights is at the heart of this document. The NTC order closing down ABS-CBN should be revoked because it is in clear violation of the Bill of Rights,” ani Pichay.
Nitong Lunes, Mayo 4, inihain ni Pichay sa Kamara ang House Bill 6680 para amiyendahan ang RA 7925 o ang Pubic Telecommunications Policy Act of 1995.
Hindi kasi aniya kasama ang mga broadcast companies sa mga obligado na magkaroon ng legislative franchise bago makapag-operate.
“Clearly, there is a gap in the law because only public telecommunications entities are required to obtain a franchise which excludes those persons engaged in broadcasting companies,” ani Pichay.
Nitong Martes naman ay ipinasara ng NTC ang ABS-CBN matapos igiit na sa ilalim ng RA 3846, o ang Radio Control Act, obligado ang mga radio broadcast entity na magkaroon muna ng legslative franchise bago pahintulutan na makapag-ere.
Pero ayon kay Pichay, na-supersede na ng repealing clause RA 7925 ang batas na tinukoy ng NTC sa pagpapasara nito sa ABS-CBN.
