Labag sa nilalayon ng anti-terrorism law ang mungkahi ni Armed Forces chief Lieutenant General Gilbert Gapay na isama sa implementing rules and regulations (IRR) ng naturang batas ang pag-regulate sa social media.
Sinabi ni Biazon, na isa sa mga initial proponents ng batas, walang probisyon sa ilalim ng anti-terrorism law na nagsasabing pinapahintulutan ang mga otoridad na i-regulate ang social media dahil hindi naman intensyon ng mga mambabatas na apakan ang freedom of expression at right to privacy.
“To insert it into the Implementing Rules and Regulations (IRR) would be a contradiction to the intention of the framers of the law who had already purposely left it out, as well as a circumvention of the rule that the IRR should not go beyond what is provided by the letter of the law,” ani Biazon.
Sa isang virtual presser, sinabi ni Gapa na ginagamit ng mga terorista ang social media para gawing radikal ang kabataan.
“We will be providing some inputs on countering violent extremism and likewise maybe even regulating social media. This is the platform now being used by the terrorists to radicalize and even plan terrorist acts,” ani Gapay.
Ito aniya ang dahilan kung bakit kailangan magkaroon ng specific provisions sa IRR patungkol sa pag-regulate nang paggamit ng social media.
Pero sinabi ni Biazon na sa ilalim ng Section 16 ng batas ay pinapahintulutan na batas ang mga otoridad na habulin ang mga terorista na gumagamit ng social media para sa kanilang propaganda sa pamamagitan ng surveillance sa mga suspects at interception at recording ng komunikasyon ng mga ito.
Aniya, sa pamamagitan ng utos mula sa Court of Appeals ay maari nang magka-access ang mga law enforcement o investigators sa mga datos at impormasyon na maari nilang gamitin sa case building laban sa mga suspected terrorist.
“There is no need for a power to regulate social media, which would mean that all users of social media, a majority of which are not terrorist suspects, would be vulnerable to breaches of privacy or restraint on freedom of expression,” giit ni Biazon.
