Nagpaliwanag ngayon ang Department of Justice (DoJ) kung bakit itutuloy pa rin nila ang imbestigasyon sa mga kasong isinampa ng PNP-Criminal Investigation and Detection Group (CIDG) laban kina Vice President Leni Robredo sa kabila ng mga alegasyon na may papel ang Office of the Solicitor General (OSG) sa pagbuo ng salaysay ni Peter Joemel Advincula.

Ayon kay Guevarra, hindi mahalaga kung sino pa ang bumuo ng complaint-affidavit.

Sinabi ng kalihim na ang pinakamahalaga ay kung masusuportahan ba o hindi ng mga ebidensiya ng PNP-CIDG ang inihain nitong reklamo at kung sapat ba ito o hindi para magkaroon ng probable cause para kasuhan ang mga respondents sa korte.

Sinabi ng kalihim na ito ang dahilan kaya nais niyang masimulan na agad ang preliminary investigation sa mga reklamo.

Una nang bumuo si Guevarra ng DOJ panel of prosecutors na didinig sa reklamo.

Kabilang sa mga sinampahan ng reklamong inciting to sedition ay sina Vice President Leni Robredo, dating Senador Antonio Trillanes at maging ilang paring Katoliko.

Ang reklamo ay nag-ugat umano sa Project Sodoma ng oposisyon na isiniwalat ni Advincula na layuning siraan at pabagsakin ang pamahalaang Duterte.

“As far as the DOJ is concerned, what is of utmost importance is whether or not the complainant PNP-CIDG’s evidence will support its allegations and establish probable cause against all the respondents, regardless of who drafted the complaint-affidavit. that’s why i want the special panel of state prosecutors to commence the preliminary investigation immediately,” ani Guevarra.

Sa panig naman ng abogado ni Advincula na si Atty. Larry Gadon, sinabi nitong wala siyang ideya sa partisipasyon umano ng OSG na posibleng kinonsulta ng PNP-CIDG.

Pero iginiit nitong walang mali kung kumonsulta man ng CIDG ang OSG dahil normal lang naman daw sa mga government agencies na magpasaklolo sa opisina ng Solicitor General para sa legal advice.

“The OSG was not present when the statements of Bikoy were being taken. I had no knowledge of any participation of OSG which was probably consulted by the CIDG after the statements were taken . It is perfectly normal for any governmeny office govt agency to seek the advice or consult the OSG for correction of any legal matter in line with their work, there is nothing wrong nor sinister with that since the OSG is the lawyer of the government. All agencies consult the OSG. I take exception on the statements of Prof Pacifico Agabin that since OSG was allegedly involved in the preparation of the Bikoy Affidavit it could mean oppression of the opposition. This is a gross misconception of the functions of the OSG . To what i know , the OSG gives legal advise and opinion to any govt agency without predetermining political affiliation of people involved in an issue brought before the OSG . The acts of OSG in giving advise should not be translated right away into oppresssion of opposition otherwise the OSG will be stifled . This will result to paralysis of their function. The OSG in a larger sense serves as the legal department of the government to which any govt agency may refer any matter that may involve legal issue,” wika ni Gadon.
