Dinepensa ni Committee on Ways and Means chairperson at Albay Rep. Joey Salceda ang pagdagdag sa pondo ng unprogrammed appropriations sa ilalim ng 2024 national budget.
Winelcome naman ni Salceda ang posibleng paghahain ng petisyon sa Korte Suprema (SC) para kwestyunin ang P449 bilyong dagdag sa unprogrammed appropriations ng 2024 General Appropriations Act (GAA).
Binigyang-diin ng ekonomistang mambabatas na normal lamang na may kumukwestiyon laban sa batas at hindi exempted dito ang General Appropriations Act.
” So, any party can file any suit against the 2024 GAA to their satisfaction,” pahayag ni Salceda.
Magugunita, inihayag ni Albay Rep. Edcel Lagman na ang ginawang aksion ng bicameral conference committee na dagdagan ang unprogrammed appropriations sa P449.5 billion ay isang “constitutional infirmity.”
Sinabi ni Salceda na nuong budget deliberation, humingi ng gabay ang Kongreso sa Department of Budget and Management (DBM) at sa records ng Constitutional Commission.
Batay sa naging tugon ng DBM, ang unprogrammed appropriations ay hindi bahagi ng fiscal program at ang programmed appropriations lamang ang napapailalim sa Article VI, Section 25 ng Constitution, o ang pagbabawal laban sa pagtaas ng appropriations na inirerekomenda ng Pangulo.
“At its core, the logic of the Constitutional provision is simple: Congress should not overstep the fiscal deficit programmed by the President. Indeed, this view is affirmed by the Supreme Court, in Sarmiento vs. the Treasurer of the Philippines [G.R. No. 125680 & 126313. September 4, 2001], which also cites the records of the Constitutional Commission. In the words of the Constitutional Commissioner Christian Monsod, it is to ensure that the budget does not “put the government in debt or in deficit.” (Vol 2, p. 188 of the Records of the Constitutional Commission),” paliwanag ni Salceda.
Binigyang-diin din ni Salceda na sa ilalim ng Article VII, Section 22, ang Pangulo ay inaatasan na magsumite ng Badyet ng mga Paggasta at Pinagmumulan ng Pananalapi bilang batayan para sa badyet.
Inihayag naman ni Salceda na ang partymate ni Rep. Lagman si dating Senate President Franklin Drilon ay dinepensa ang increase sa unprogrammed appropriations bilang constitutional.
