Nanindigan ang kampo ni Vice Pres. Leni Robredo, na mananatili itong bise presidente ng bansa kahit ano pa ang maging desisyon ng Presidential Electoral Tribunal (PET) sa electoral protest ni dating Sen. Bongbong Marcos.
Bukas, October 8, muling tatalakayin ng Korte Suprema, na siyang umuupo bilang PET, ang report ni Associate Justice Benjamin Caguioa sa initial recount assessment.
Ayon sa lead counsel ni Robredo na si Atty. Romulo Macalintal, sakaling maging pabor kay Marcos ang resulta ng recount, ay magde-desisyon muli ang PET kung itutuloy nito ang pagbibilang.
“I just want to make it very clear that whatever will be the decision or resolution of the PET in the election protest of Bongbong Marcos against VP Leni Robredo, as reported in various media and the subject of various speculations, VP Robredo will remain as Vice President,” ani Macalintal.
“This is so because the only issue that will be the subject of said decision, which was reported to be issued on October 8, will only resolve whether or not the election protest of Marcos will continue after the PET has recounted the ballots from the three pilot provinces (Camarines Sur, Iloilo, and Negros Oriental) that he chose.”
Sa ilalim kasi ng Rule 65 ng 2010 PET rules, pagbobotohan ng tribunal ang desisyon kung tatapusin na nito sa kasalukuyang level ang pagbibilang, o ipagpapatuloy pa ang recount, matapos ang examination sa napiling pilot provinces.
Una ng humiling ang kampo ni Marcos sa PET para ituloy ang pagsilip sa mga balota ng Basilan, Lanao del Sur at Maguindanao.
Pero nasa kamay pa ng en banc kung itutuloy nito ang recount batay sa nabanggit na PET rule.
“If the PET says that Marcos has made a substantial recovery, then the PET will rule that the protest shall continue, insofar as the ballots and/or election returns questioned by Marcos from 22 remaining provinces and 5 highly urbanized cities. In which case, Robredo remains as Vice President pending recount of ballots or returns from said 22 provinces and 5 HUCs.”
“If PET rules that Marcos was unable to gain any substantial recovery from the recount of ballots from his three pilot provinces (Camarines Sur, Iloilo, and Negros Oriental), then his protest will be dismissed and VP Leni’s victory will be affirmed.”
“Thus, whatever will be the forthcoming resolution or decision of the PET, VP Leni remains as Vice President.”

Nilinaw naman ni Chief Justice Lucas Bersamin na hindi totoo ang mga ulat na nagkasundo na ang PET para bumoto pabor kay Marcos.
