Ibinasura ng Sandiganbayan ang hiling ng convicted pork barrel scam mastermind na si Janet Lim Napoles na nagpapa-kwestyon sa mga ebidensya ng prosekusyon hinggil sa kanyang kasong plunder.
Batay sa resolusyon ng 5th Division, sinabi ng anti-graft court na sapat ang naturang mga ebidensya para suportahan ang reklamong pandarambong.
Bukod kay Napoles, ibinasura rin ng Sandiganbayan ang demurrer to evidence ni dating APEC Party-list Rep. Edgar Valdez sa parehong kaso.
“Valdez and Napoles hypothesize in their respective demurrers that the jurisdictional amount of P50,000,000.00 for the crime of plunder to prosper was not established by the prosecution.”
Nag-ugat ang kaso ng dalawa matapos umanong magkamal ng P57-milyon na kickback ni Valdez sa pamamagitan ng paglaan nito ng kanyang Priority Development Assistance Fund (PDAF) sa pekeng non-government organizations ni Napoles.
Maliban dito, sinabi rin ng korte na may sapat na ebidensyang magpapatunay na may nakaw na yaman ang dating kongresista.
“It was established that they conducted an investigation on Valdez’s PDAF utilization. They discovered that some of the PDAF projects of the said accused were liquidated but not fully implemented.”
Itinakda sa September 12 ang susunod na pagdinig para sa inisyal na presentasyon ng ebidensya sa mga kaso.
