Iginagalang ng kampo ng petitioners ng Same Sex Marriage ang desisyon ng Supreme Court na nagbasura sa hiling na gawing ligal ang pagpapakasal ng LGBTQIA+ (Lesbian, Gay, Bisexual, Transgender, Queer, Intersex and Asexual) community sa bansa.

“The Supreme Court has made its judgement on the petition. But the history will be the ultimate judge.”

Sa isang statement sinabi ni Atty. Jesus Falcis na isang tagumpay ng maituturing ang pagkakadinig ng Kataastaasang Hukuman ng kaniyang inihaing petisyon.

Nagpasalamat ang abogado sa mga mahistrado dahil sa pagkakataong ibinigay ng hudikatura lalo na’t nagbigay daan daw ito para magkaroon ng kaalaman ang publiko sa issue.

“We already consider as a victory the fact the Supreme Court held oral arguments last year and we thank the SC for the opportunity to educate the public.”

Bagamat inaasahan na raw ng kanilang panig na matatalo ang petisyon sa oral arguments, hindi pa rin umano sila mawawalan ng pagasa sa pagiging ligal ng Same Sex Marriage sa bansa.

“The Petitioners had hoped to win but we expected that we would lose… this is a temporary setback. In other countries from the US to Australia to Taiwan, they had to lose before they won marriaga equality.”

“The Philippines will be no different. The future for the LGBT community is colorful like a rainbow.”

Sa desisyon ng Supreme Court en banc sinabi ni Associate Justice Marvic Leonen na “premature” pang maituturing ang mga argumentong inilahad ni Falcis at kampo nito sa pagdinig noong nakaraang taon.

“Premature petitions filed by those who seek to see their names in our jurisprudential records may only do more harm than good,” ani Leonen.

“Good intentions are not substitute for deliberate, conscious and responsible action. Litigation for the public interest for those who have been marginalized and oppressed deserve much more than the way that it has been handled in this case.”

Ayon sa mahistrado, bigo ang petitioners na makapagpalutang ng aktwal na kaso ng kontrobersya na magpapatunay na may hinarang na attempt ng same sex marriage.

“It is only through the existence of actual facts and real adversarial presentations that the court can fully weigh the implications and consequences of its pronouncements.”

Nilabag din umano ng petitioners ang prinsipyo ng hierarchy of courts dahil sa mababang hukuman daw muna dapat inihain ng petitioners ang kanilang apela.
