Ibinasura ng Sandiganbayan ang mga kasong graft at malversation ng dalawang opisyal mula sa non-government organizations na sangkot sa Priority Development Assistance Fund (PDAF) scam.
Batay sa 29-pahinang desisyon ng 1st Division, sinabi ng korte ng bigong patunayan ng prosekusyon na incorporators ng Kabuhayan at Kalusugang Alay sa Masa Foundation (KKAMFI) at Aaron Foundation Philippines Inc (AFPI) sina Godofredo Roque and Morrys Ang.
Kinasuhan ng tig-dalawang counts ng graft at malversation sina Roque at Ang noon matapos umanong makipag-sabwatan kay dating La Union Rep. Thomas Dumpit Jr. para mabulsa ang P6.5-milyong halaga ng PDAF ng former congressman.
Sinasabing P6-milyon ang napunta sa AFPI, habang nabulsa umano ng KKAMFI ang P500,000 sa tulong ng mga opisyal ng Technology and Livelihood Resource Center (TLRC).
“After a careful consideration of the evidence adduced by the prosecution, the court is convinced that the guilt of accused Roque and Ang for the crimes charges has not been proven and with the required quantum of proof at this stage of the proceedings. None of the evidence either directly or indirectly through adequate circumstantial evidence that accused Roque and Ang committed actual overt acts to show that they became part of the conspiracy in the commission of crimes charged in these cases,” ayon sa anti-graft court.
Paliwanag ng korte, hindi sapat na basehan para madiin sa akusasyon sina Roque at Ang kahit pa mapatunayang incorporators ang mga ito.
Iginiit din nito ang testimonya ng isang opisyal ng Commission on Audit na hindi nagbanggit ng pananagutan ng dalawa sa PDAF.
“Aside from the articles of incorporation, general information sheets and by-laws, no other documentary evidence nor testimony was put forth by the prosecution to show their respective participations in the unlawful disbursements of accused Dumpit, Jr.’s PDAF,” dagdag ng anti-graft court.
Inalis na ng korte ang bail bonds na una nilang ipinataw laban sa dalawang akusado.
