Ibinasura ng Sandiganbayan ang graft case ni dating Light Rail Transit Authority (LRTA) administrator Melquiades Robles at 12 iba pa dahil sa kakulangan umano ng ebidensya sa kaso.

Batay sa 18-pahinang ruling ng 5th Division, sinabi ng korte na bigo ang prosekusyon na mai-presenta ang orihinal na kopya ng mga dokumentong kailangan sa reklamo.

“Considering that there is no conclusive evidence to establish 321 janitors were agreed upon, the monthly payment of P3.37 million [for year 2009] alleged in the information to have been paid to the Joint Venture for their services also has no leg to stand on,” ayon sa korte.

“A review of the prosecution’s evidence, which include those which were not admitted by the court, shows that there is no basis or computation on how this amount was arrived at.”

Kabilang na ang kasunduan sa pagitan ng LRTA at napiling maintenance service provider noong 2009 na COMM Builders and Technology, Inc.

Nakasaad kasi sa reklamo na may 321 janitor na ide-deploy sa ilalim ng joint venture agreement ng dalawang kampo.

“These figures are too far off the figures alleged in the information which pegs it at P12 million for 2009 and P1 million per month. The prosecution’s own evidence conflicts with the allegations in the information and is therefore not to be given any credence.”

Hindi umano nakasaad sa mga ebidensya na unang inilatag ng prosekusyon ang P3.37-milyong pondo na ibinayad umano sa nasabing mga janitor.

Mali rin daw ang computation ng witness ng Office of the Ombudsman sa sinasabing ginastos ng LRTA at kompanya.
