Mariing kinuwestiyon ni dating Senate President Pro Tempore Loren Legarda ang umano’y pagtatangkang magpalit ng liderato sa Senado gamit lamang ang 12 boto noong Miyerkules, Hunyo 3, at iginiit na labag sa Konstitusyon at sa umiiral na rules ng Mataas na Kapulungan.
Matatandaang kahapon sa plenary session, iniluklok ng mga senador mula sa minority bloc kasama si Senador Francis “Chiz” Escudero mula sa majority bloc si Senador Sherwin “Win” Gatchalian bilang bagong Senate President Pro Tempore at acting Senate President, matapos na hindi dumalo ang ilang senador mula sa majority bloc.
Sa inilabas niyang pahayag, sinabi ni Legarda na walang senador ang maaaring mahalal o kumilos bilang Senate President kung walang kinakailangang mayorya ng boto ng buong Senado.
Binigyang-diin niya na malinaw sa Article VI, Section 16(1) ng 1987 Constitution na ang Senate President ay dapat mahalal sa pamamagitan ng mayoryang boto ng lahat ng miyembro ng Senado.
“Since the Senate is composed of twenty-four Senators, that majority is thirteen. By the fact that the Senators present did not have thirteen votes, they could not validly elect a Senate President or authorize any Senator to act as Senate President,” ani Legarda.
Ipinaliwanag din ng senadora na maging ang iba pang opisyal ng Senado gaya ng Senate President Pro Tempore, Senate Secretary, at Sergeant-at-Arms ay nangangailangan din ng hindi bababa sa 13 boto upang mahalal alinsunod sa Senate Rules.
“Under Rule II, Section 2 of the Rules of the Senate, the officers of the Senate shall be elected by the majority vote of all its members,” saad ni Legarda.
Binigyang-diin ng beteranang mambabatas na maging ang mga kasapi ng minority bloc ay kinikilala ang naturang requirement, kaya hindi umano sila bumoto sa naturang proseso.
“That is why the minority Senators did not vote for a Senate President: they lacked the required thirteen (13) votes,” dagdag niya.
Ayon pa kay Legarda, hindi maaaring magsagawa ng official business ang Senado kung walang sapat na quorum.
“A majority of twenty-four is thirteen. Without thirteen senators present, the Senate cannot validly transact business. Without a quorum of thirteen (13), it is clear that no change of committee chairmanships can be done,” aniya.
Iginiit din niya na hindi dapat mabawasan ang representasyon ng mga halal na senador dahil lamang sa pansamantalang pagliban ng ilan sa kanila.
“The temporary absence of some members should not become a reason to lower their representation or weaken the mandate of the people who elected them,” sabi ni Legarda.
Dagdag pa niya, nananatiling bahagi ng buong Senado ang bawat miyembro hangga’t walang legal na dahilan tulad ng pagbibitiw, pagpapatalsik, o iba pang kinikilalang batayan sa batas.
Sa huli, nanawagan si Legarda ng mahigpit na pagsunod sa Konstitusyon sa gitna ng umiinit na usapin sa liderato ng Senado.
“We remain firm in our respect for the Constitution,” aniya.
