Nagkasundo ang House Prosecution at Defense Panel para sa stipulation ng ilang “common exhibits” sa pagpapatuloy ng pagdinig sa misuse of confidential funds charges laban kay Vice President Sara Duterte ngayong Lunes, Agosto 3.
Ang stipulation of common exhibits ay ang kasunduan ng magkabilang panig sa korte na tanggapin ang mga parehong ebidensya nang hindi na kailangang patunayan pa kung totoo ba ang mga ito.
Unang hiniling ni House Prosecution counsel Atty. Lorna Kapunan sa Senate Impeachment Court ang pag-stipulate sa common exhibits sa pagitan nila ng depensa. Humiling naman ng limang minutong suspensiyon sa pagdinig si Defense counsel Atty. Michael Poa upang mapag-aralan ang kahilingan ng prosekusyon.
Sa pagpapatuloy ng paglilitis, nagpahayag ng pagsang-ayon ang defense panel ni Vice President Sara Duterte na tanggapin ang ilang documentary evidence ng House prosecution, maliban sa 845 acknowledgment receipts na mula Disyembre 21 hanggang 31, 2022 na kanilang tinututulan.
Hindi rin tinanggap ng depensa ang ikalimang proposed stipulaiton ng prosekusyon, kung saan nakasaad na natanggap ng Office of the Vice President (OVP) ang confidential funds na nagkakahalaga ng P125 milyon noong Disyembre 20, 2022, na ginastos sa loob lamang ng 11 araw.
Narito pa ang karagdagang proposed stipulations ng prosekusyon na in-adopt ng depensa:
- The DepEd was alloted confidential funds in the fixed amount of Php37.5M quarterly;
- The OVP was alloted confidential funds in the amount of Php125m in December 2022;
- The OVP and the DepEd withdrew their respective confidential funds’ quarterly allocation in full from the 1st to 3rd Quarters of 2023he documents submited by the OVP and the DepEd were all signed by the authorized signatories;
- (no stipulation)
- That the signatories above the names Gina Acosta, Julieta Villadelrey and Rosalynne Sanchez in the OVP documents are their signatories. and
- That the signatories above the names Edward Fajarda, Ma. Rhunna Catalan, Annalyn Sevilla and Gloria Jumamil-Mercado in the DepEd liquidation documents are their signatories.
Pinasalamatan naman ni Atty. Kapunan ang defense counsel sa pag-stipulate ng ilan sa kanilang marked evidences.
Sinegundahan din ni Trial Presiding Office Francis “Chiz” Escudero na pinasalamatan ang magkabilang panig sa pagpapaikli sa pagliliits at pagtulong sa korte.
Ayon kay Atty. Kapunan, nasa kabuuang 10 kahon ng mga ebidensiya ang nabawas o 2/3 ng kabuuang 15 kahon.
