Patong-patong na kasong kriminal ang isinampa laban sa mga importers at customs brokers ng sigarilyo at general merchandise.
Ang mga kaso ay isinampa ng Bureau of Customs (BoC) sa Department of Justice (DoJ).
Humaharap ang JDR General Merchandise at customs broker nito ng kasong kriminal dahil sa umano’y importation at misdeclaration ng dalawang shipments ng mga pekeng sigarilyo at general merchandise noong March 17, 2021 sa Manila International Container Port (MICP).
Ang estimated value ng shipments ay P50.540 million.
Base sa reklamo, nilabag daw ng importer ang mga probisyon ng Customs Modernization and Tariff Act (CMTA); Section II (e) ng Customs Memorandum Order No. 20-2006; Sections 41 at 42 of R.A. 10963 o mas kilalang ax Reform for Acceleration and Inclusion (TRAIN) Act (TRAIN) Law; Section 10 ng National Tobacco Administration (NTA) 079-2005; NTA Memorandum Circular No. 03, s. 2004 at Section 155 na may kaugnayan sa Section 170 ng R.A. 8293 o Intellectual Property Code of the Philippines.
Naghain din ang Bureau ng criminal case laban sa Gingerbreadman Trading at customs broker nito dahil sa umano’y importation ng misdeclared general merchandise na nagkakahalaga ng P1.319 million.
Ang mga kontrabando ay naharang sa MICP noon pang August 15, 2020.
Nilabag daw ng mga importer maging ng kanilang mga customs broker ang CMTA.
